1. Nature of Our Service
Off Market Gold Coast is a specialised brokerage and introduction platform.
- We are not a Real Estate Agency: We do not act as an agent for any party, we do not conduct open homes, and we do not negotiate contracts of sale.
- We are not a Buyer’s Agency: We do not provide specific financial or investment advice.
- Our Role: We act as a central hub to facilitate introductions between Buyers, Sellers, and third-party Property Professionals (Real Estate Agents and Buyer’s Advocates).
2. Eligibility and Intent
By using this platform, you represent that:
- You are at least 18 years of age.
- You have a genuine intent to buy or sell property on the Gold Coast.
- All information provided in our Property Criteria or Property Detail forms is accurate to the best of your knowledge.
3. For Sellers (The “No Cost” Model)
- Registration: Listing your property profile and “Make Me Move” price is free.
- No Exclusivity: Using our platform does not prevent you from listing your property elsewhere, unless you enter into a separate written agreement with an introduced agent.
- Fees: We do not charge Sellers a commission or marketing fee. Our platform is funded via our professional network.
4. For Buyers
- Registration: Accessing our network and receiving property matches is free for Buyers.
- Professional Fees: If we introduce you to a third-party Buyer’s Agent, any professional fees or commissions charged by that agent are a matter between you and that agent. Those fees must be disclosed to you by the agent upfront.
5. Third-Party Professionals
Our network consists of independent Real Estate Agents and Buyer’s Advocates.
- No Liability: While we vet our professional network for quality, Off Market Gold Coast is not responsible for the conduct, advice, or services provided by these third parties.
- Independent Contract: Any real estate transaction resulting from an introduction is governed by a separate contract between the Buyer, Seller, and their respective agents.
6. Privacy and Discretion
- Off-Market Integrity: Users agree not to disclose sensitive “off-market” property details (addresses, owner names, or internal photos) provided through our service to any outside parties or public portals.
- Data Use: You consent to Off Market Gold Coast sharing your requirements (Buyer) or property highlights (Seller) with our vetted network to facilitate a match.
7. Limitation of Liability
To the maximum extent permitted by law, Off Market Gold Coast shall not be liable for:
- Any errors or omissions in property descriptions provided by Sellers.
- The failure of a transaction to proceed after an introduction is made.
- Any financial loss or disappointment arising from market fluctuations or property performance.
8. Intellectual Property
All content on this website, including the “Off Market Gold Coast” branding, matching logic, and website copy, is the intellectual property of [Your Company Name/Your Name].
9. Governing Law
These terms are governed by the laws of Queensland, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts in Queensland.
